Voluntary Participation
The customer acknowledges that you have voluntarily chosen and requested to participate in individual consultation and/or coaching, yoga class, workshop, event, and/or program with Anna Miley.
Acknowledgment
The customer is aware that participation in the individual consultation and/or coaching session, yoga class, workshop, event, or program includes physical movement which carries with it the risk of injury. The customer acknowledges that a certain minimum level of physical health and fitness will be required. By signing up for any class, workshop, event or programme, the customer represents that he/she possess the level of health necessary to participate in these activities. The customer is voluntarily participating in these activities with knowledge of the risks of injury. The customer assumes all responsibility and liability for any and all injuries he/she may sustain due to his/her participation in these activities.
Release
Prior to your first class or participation in an workshop, event or program with Anna Miley, please make sure that any/all forms requested have been completed and submitted.
In consideration for being permitted to participate in the exercise/yoga class, workshop, event, or activity, the customer agrees that he/she, his/her heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of, any of the hosts, instructors, organizers, or participants in the exercise/yoga class, workshop, event, or activity including but not limited to Anna Miley, for injury or damage resulting from my participation in such yoga class, workshop, event, or activity. The customer releases all such hosts, instructors, organizers, and participants, their agents and heirs, from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter may have for any and all injury, illness, loss of or damage to property associated with my participation in the yoga class, workshop, event, or activity.
The customer has the responsibility to discuss any health concerns with a health care professional and to make the instructor aware of any medical conditions or physical limitations before class, workshop, event, programme.
If you are pregnant, become pregnant or are post-natal or post-surgical, by signing up to class you confirm that you have physician's approval to participate.
The customer will inform Anna Miley or any cover teacher/instructor of any medical changes.
Payments/Refunds/Cancellations
Yoga Classes
Once registered there is a strict cancellation policy.
Class Pass
When you purchase a class pass from Anna Miley. In respect of the commitment that we are both making, the following terms apply to all students purchasing a class pass:
All class passes are non-transferrable and non-refundable in whole or in part.
Class passes have periods of validity, as stated at time of purchase.
Monthly Memberships
All monthly memberships are non-transferrable and non-refundable in whole or in part.
The membership fee will be debited directly from your account on the 1st of each month via Hey Marvelous and Stripe.
The membership can be cancelled at any time via your account in Hey Marvelous.
Workshops/Events/Trainings
Payment is due in full at time of booking and is non-refundable.
In the event that Anna Miley or the facilitator of the training has to cancel the event a refund (minus the Booking Fee) will be issued via the original payment method or the method attracting the least merchant/administrative fees.
For workshops/events/trainings attracting a booking fee, the booking fee is non-refundable in any circumstance.
If payment plans have been agreed, all payments must be made on time in order to proceed with the Package or Programme.
Coaching Programs/Packages and Private Lessons Payment
All fees must be paid on time in order to commence the Package or Programme. All packages and programmes are non transferable and non refundable.
If payment plans have been agreed, all payments must be made on time in order to proceed with the Package or Programme.
In either case you are responsible for the full payment of fees for the entire Programme regardless of whether you actually attend, complete or use all of the component events, products or inclusions (as applicable).
Your payment plan will be set up through Stripe unless otherwise agreed.
Package/Program Completion
All Programmes must be completed within the stated programme terms. There will be no credit for enrolments not completed within this time.
The sessions will be delivered face to face, by phone call, Zoom, Voxer or other as appropriate.
If you cancel a single session within 12 hours of the appointment your session will be forfeited. A minimum of 12 hours is required to reschedule an appointment.
Package/Programme Changes/Cancellation
If for any reason I deem it necessary to change any session dates, venue, city, speaker, content, title or hours I may do so by notifying you of the changes I make. There is no refund available under any of these circumstances.
All Packages and Programmes are non refundable. If you do not attend a Program component in which you are enrolled a refund or credit is not available and you will need to purchase the full Programme again or additional single sessions as agreed if you wish to add additional sessions.
If you cancel a single mentoring session within 12 hours of the appointment your session will be forfeit. A minimum of 12 hours is required to reschedule an appointment.
Financial, legal and medical advice disclaimer
The information provided during or in relation to the programme is for general purposes only and it does not purport to be comprehensive or to render specific advice. Nor should it be regarded as financial, legal or medical advice. This disclaimer does not purport to exclude any warranties implied by law which may not be lawfully excluded.
Intellectual Property
All material relating to the Programme for which you are enrolling whether presented during, before or after the Programme, is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.
Group programmes may be recorded and these recordings may be sold as stand alone programs in the future. By participating in any group programme, event with Anna Miley you consent to be photographed, filmed and having your voice recorded and these recordings/photos being used for advertising and/or sold at a later date. You also agree that there will be no financial or other form of compensation for you for this.
Confidentiality
I respect your privacy and must insist that you respect the privacy of other fellow participants. You agree not to disclose proprietary information, ideas, plans and trade secrets that are disclosed by other Participants in confidence, nor to violate the publicity, privacy or intellectual rights of any Programme participant.
Application Approval and Termination of programme enrolment
I am committed to providing all clients with a positive experience and may not approve all applications to join this programme. In this case I will refund you the amount paid to me less any enrolment cancellation costs. Once the Programme starts, I may terminate this agreement and your participation in the Programme without refund or forgiveness of remaining payments if you become disruptive or difficult to work with, if you fail to follow the Programme guidelines, or if you impair the participation of others.
General
These terms and conditions shall be governed by and construed in accordance with Australian law and are subject to the jurisdiction of the courts of Australia.

As the services provided by Anna Miley continues to evolve, our practices, web sites and mobile app, and incorporate new technologies to improve communication, policies may change. You are encouraged to refer to this policy on an ongoing basis to stay abreast of our most current Privacy Policy practices.
Currently Anna Miley gathers personal information (including name, e-mail address, phone number and postcode) as well as sensitive information (such as your medical conditions) to provide you with tailored and appropriate care and for contact purposes when users opt to fill out an email submission form or call us directly to inquire about our company or our services. In some cases we ask for other optional information including additional contact information and certain demographic information (such as gender).
We have access to and collect information that you voluntarily provide via website submission form, email, online tracking data or other direct contact from you. Your information is not sold or rented information to anyone.
Your information will be used to respond to you about the reason you contacted Anna Miley.
